In 2009, President Obama signed the Family Smoking Prevention and Tobacco Control Act into law. However, because e-cigarettes were not very popular or well known at the time, the vaping industry was omitted from the FDA’s regulations concerning tobacco products. As such, the vaping industry has been allowed to roam free for more than a decade without oversight from government regulators.

Advocacy groups, parents, and many members of the public, are hoping the FDA will crack down and refuse to provide Juul and other e-cigarette manufacturers with what they want – approval of a product that has already injured and caused illnesses (and even death in some cases) to numerous individuals in the United States, with many victims being minors.

Juul faces thousands of lawsuits on all fronts – from individual consumers, parents on behalf of their injured or ill children, state and local governments, advocacy groups, and institutions, alleging that Juul’s advertisement campaigns targeted to youths fueled the e-cigarette epidemic among users under the age of eighteen.

Vaping injuries range from minor illnesses to burns or even death. Not only have some e-cigarettes “exploded,” demonstrating product safety dangers, but most of the harm has come in the form of serious illnesses suffered by minors and young adults. Examples of illnesses and injuries that have affected a wide range of e-cigarette users include, among others, the following:

  • E-cigarette or vaping product use-associated lung injury (EVALI), some of which can be fatal
  • Lung infection
  • Fluid-filled lungs
  • The development of long-term breathing conditions, such as asthma and chronic obstructive pulmonary disease (COPD)
  • Collapsed lung
  • Pneumonia
