Searcy Denney Partners Working in DePuy and Stryker Multi-District Litigation
Mult-district litigation (MDL) is the process set up by the federal courts to manage often many thousands of claims made against the same product or drug. Usually the defect being alleged in the product or drug is the same and each of the claiming plaintiffs have similar, but not identical injuries and damages. Various committees are formed by the court in the MDL to benefit all the plaintiffs: executive committee, steering committee, expert witness committee, science committee and others.
Thousands of injured people have been consolidated into an MDL in Texas, involving injuries and revision surgeries following their implantation with Pinnacle metal-on-metal hip implants manufactured and marketed by DePuy Orthopaedics. These consolidated federal court lawsuits are pending before Judge Ed Kinkeade in Dallas, Texas.
Calvin Warriner, III, a partner with Searcy Denney Scarola Barnhart & Shipley, in West Palm Beach was recently appointed to serve on the Plaintiffs’ Steering Committee for MDL No. 2244, representing the thousands of individual plaintiffs who suffered DePuy implant injuries.
Mr. Warriner has been chosen to focus his work on behalf of the injured plaintiffs, on developing expert witnesses to testify on behalf of the plaintiffs in future trials in the MD. Those trials are slated to begin in a few months. Mr. Warriner has brought his extensive experience in working with and developing scientific expert witnesses in other hip implant cases to the benefit of plaintiffs in the Pinnacle MDL litigation. Mr. Warriner is an authority in hip implant design and failure analysis.
The Mass Tort Unit of the law firm of Searcy Denney Scarola Barnhart & Shipley represents hundreds of plaintiffs injured by metal-on-metal and modular hip implants manufactured by DePuy, Stryker, Zimmer, Wright Medical, Biomet, and other manufacturers. Mr. Warriner also serves on the Plaintiffs’ Steering Committees for the Stryker Rejuvenate and ABG II Modular Hip Implant Litigation (MCL No. 296 in New Jersey state court) and the DePuy ASR Hip Implant Litigation (MDL No. 2197). Mr. Warriner was involved in the negotiation of the landmark $1.4 billion settlement in 2014 of Stryker ABG II and Rejuvenate modular hip implant cases.
Brenda Fulmer, another Searcy Denney partner, has been appointed to the Plaintiffs’ Steering Committee for MDL No. 2391 for Biomet metal-on-metal hip implants and on the Discovery Committee for MCL No. 296 for Stryker Rejuvenate and ABG II hip implants.
