Fighting for Justice in the Zimmer M/L Taper Hip Multidistrict Litigation (MDL)
Searcy Denney partner, Brenda Fulmer, has been appointed by the Court to the Plaintiffs’ Steering Committee in the Zimmer M/L Taper Hip Prosthesis or M/L Taper Hip Prosthesis with Kinectiv Technology and VerSys Femoral Head Products Liability Litigation. This coordinated federal court litigation involves individual lawsuits that have been filed by patients that allege that Zimmer’s M/L Taper, VerSys, and Kinectiv hip implant components are defectively designed or contained inadequate warnings regarding the risks of corrosion, trunnionosis, and premature hip implant failure. These Zimmer hip implant products have not been recalled by the FDA or Zimmer. The lawsuits focus on Zimmer’s use of dissimilar metals and other alleged design defects in the products. The lawsuits are pending in MDL No. 2859 before Judge Paul A. Crotty in the United States District Court for the Southern District of New York in New York City. A jury rendered a verdict of $2,000,000 against Zimmer in December 2017 in a case in New Mexico involving the Zimmer M/L Taper hip implant product.
